Prosecutors argued that the CEO created a sham company to bypass visa caps and pay lower wages. The scheme involved filing fraudulent applications with U.S. Citizenship and Immigration Services, claiming the workers would be employed at the sham company.

The CEO became a naturalized U.S. citizen in 2015. Under federal law, citizenship can be revoked if it was obtained through fraud or misrepresentation. The government is seeking denaturalization, which would strip the CEO of citizenship and potentially lead to deportation.

The case highlights ongoing scrutiny of H-1B visa abuse. The Department of Justice has prioritized prosecuting visa fraud, particularly in cases involving high-tech firms and staffing companies. A ruling on the citizenship revocation is expected later this year.
